Judget Terms of Use
Overview
Judget is an online platform that enables people to post their daily issues and injustices by submitting them to the judgment of the Judget community. Users are encouraged to share their positions and judge the cases posted by other users. The aim of Judget is to simulate a fair and civilised court of public opinion. The confrontation of opinions is therefore a core attribute of our platform. You will likely be often exposed to opinions that you may not necessarily adhere to or agree with. We believe every users’ contribution is equal and do not warrant or endorse any position. We simply hope to provide a civically responsible platform where such issues may be discussed and judged. In achieving this goal, we believe that it is of the utmost importance that our users feel safe and confident when contributing their knowledge and opinions or when they read another user’s opinion on a given issue. The following rules help all users of the Judget community to have a safe and fair experience. As noted in our Terms of Services, you are solely responsible of the content you share on the Judget Platform.
This Terms of Use is a set of rules setting out the prohibited behaviour and content on our platform. There are four line of rules that govern your use of the Judget Platform: Watch your behaviour (I), Respect the law (II), Respect others and their rights (III) and finally Respect the Judget platform (IV).
Here is a brief overview of the rules that you must respect and comply with through your use of the Judget platform:
- You may not share any unlawful content and must comply with all applicable laws to your content and behaviour on the Judget Platform.
- The content you create may not infringe someone’s Trademark and Copyright laws.
- You may not distribute or publish any material obtained via hacking or stealing.
- You are prohibited to buy, sell, misuse or squat usernames.
- You are prohibited to engage in any abusive, hateful and discriminatory content. For an extensive explanation of our abusive and hateful behaviour policy please see below at section XX.
- You may not share any graphic violence, adult content or media depicting a deceased individual.
- You may not share and post any intimate media or private information of someone without their consent. You are also prohibited to threat to expose or hack an individual using private information or intimate media.
- You may not impersonate an individual, a group of individuals, an organization or any legal entity without their consent.
- You may not engage in spamming, fake accounts or malicious content.
The Judget Terms of Use (along with all incorporated policies), Privacy Policy, and Terms of Services collectively make up the "Judget User Agreement" that governs a user's access and use of Judget's services.
All organizations and individuals accessing or using Judget’s services must adhere to the policies set forth in these Terms of Use. Failure to do so may result in Judget taking one or more of the following enforcement actions:
- requiring you to remove prohibited content before you can again create new posts and interact with other Judget users;
- temporarily limiting your ability to create posts or interact with other Judget users;
- asking you to verify account ownership with a phone number or email address; or
- permanently suspending your account(s).If you attempt to evade a permanent suspension by creating new accounts, we will suspend your new accounts.
Please note that we may need to change these Rules from time to time and reserve the right to do so with due notification to you.
The policies set forth in this Terms of Use govern organic content on our platform, created by our users. The content you create on the Judget platform is your sole responsibility. You are free to write and share any type of content within the limitations and guidelines set forth below.
I. Watch your behaviour.
Judget is a platform where everybody is invited to share their positions and opinions on a variety of issues. Sometimes, such cases can be very conflictual and divisive. You are always entitled to your opinion and free to express it in any way you choose. We always encourage our users to share promote and confront their ideas and opinions and hope to provide a safe and efficient environment for them to do so.
However, we also expect our users to be respectful, mature and constructive when interacting within our platform. We believe in freedom of expression and open dialogue, but that means little as a principle and philosophy if voices are silenced because people are afraid to speak up. In order to ensure that people feel safe expressing diverse opinions and beliefs, we prohibit behaviour that crosses the line into abuse, including behaviour that harasses, intimidates, or uses fear to silence another user’s voice.
This is why this Terms of Use sets out a series of rules that we expect our users to comply with through their Judget experience.
A. Do not engage in any abusive behaviour
We consider abusive behaviour to include a series of actions you may undertake that might cause emotional distress or harm to others within our platform. Below we have listed a series of examples and defined certain behaviour that we consider to be abusive. These are by no means exhaustive, and an action that is not specifically mentioned below may be considered abusive.
1. Abusive conduct
It is of the utmost importance that our users should feel safe expressing their unique point of view. We believe that freedom of expression implies a free an open confrontation of opinions. It is therefore very important to protect each and everyone’s voice and to prevent them to be silenced due to abusive behaviour. This is why we prohibit behaviour that
a. Abuse and harassment: You may not engage in the targeted harassment of someone or incite other people to do so. We consider abusive behaviour an attempt to harass, intimidate, or silence someone else’s voice.
b. Unwanted sexual advances: You may not direct abuse at someone by sending unwanted sexual content, objectifying them in a sexually explicit manner, or otherwise engaging in sexual misconduct.
c. Using aggressive insults with the purpose of harassing or intimidating others. We take action against excessively aggressive insults that target an individual, including content that contains slurs or similar language. Please also note that while some individuals may find certain terms to be offensive, we will not action against every instance where insulting terms are used.
d. Encouraging or calling for others to harass an individual or group of people. We prohibit behaviour that encourages others to harass or target specific individuals or groups with abusive behaviour. This includes but is not limited to; calls to target people with abuse or harassment online and behaviour that urges offline action such as physical harassment.
2. Hateful conduct:
Freedom of expression is a human right – we believe that everyone has a voice, and the right to use it. Our role is to serve the public conversation and contribute to a collective understanding of justice. This undoubtedly requires representation of a diverse range of perspectives.
We recognise that if people experience abuse on Judget, it can jeopardize their ability to express themselves. We are committed to combatting abuse motivated by hatred, prejudice or intolerance, particularly abuse that seeks to silence the voices of certain underrepresented or marginalized groups. Any generalizations about these topics should be phrased as neutrally as possible.
a. Hateful Discrimination: Judget is a place for civil discourse. We do not tolerate content that attacks, threatens or disparages an individual or group based on race, gender, religious affiliation, nationality, ethnicity, political group, sexual orientation, disability, age or serious disease. You may not promote violence against or directly attack or threaten other people on the basis of the above-mentioned characteristics.
b. We prohibit content that makes violent threats against any identifiable target. A violent threat is a declarative statement with an intent to inflict injuries that would result in serious body harm or death.
c. Wishing hoping or calling for serious harm on a person or a group of people is also prohibited on Judget. A content that expresses desire or incites for serious body harm, disease or death against an individual or a group of people will immediately be removed.
d. Inciting fear about a certain group of people and promoting fearful stereotypes about a group or an individual is also prohibited.
e. Hateful imagery and display names: You may not use hateful images or symbols in your profile image or profile header. You also may not use your username, display name, or profile bio to engage in abusive behaviour, such as targeted harassment or expressing hate towards a person or a group of people.
Consequences: Context matters when evaluating for abusive behaviour and determining appropriate enforcement actions. Factors we may take into consideration include, but are not limited to, whether:
- the behaviour is targeted at an individual or group of people;
- the behaviour is legitimate for the content of the case posted by the user;
- the report has been filed by the target of the abuse or a bystander;
- the behaviour is newsworthy and in the legitimate public interest.
When determining the penalty for violating this policy, we consider a number of factors including, but not limited to, the severity of the violation and an individual’s previous record of rule violations. We may ask a user to remove the violating content or remove it ourselves. We may issue a warning to the user to cease and desist the violating content. Subsequent violations will result in a temporary and eventually permanent suspension of their account.
B. Do not promote violence and physical harm
a. Violence: You may not make specific threats of violence or wish for the serious physical harm, death, or disease of an individual or group of people. This includes, but is not limited to, threatening or promoting terrorism. You also may not affiliate with organizations that — whether by their own statements or activity both on and off the platform — use or promote violence against civilians to further their causes.
b. Suicide or self-harm: You may not promote or encourage suicide or self-harm. When we receive reports that a person is threatening suicide or self-harm, we may take a number of steps to assist them, such as reaching out to that person and providing resources such as contact information for our mental health partners.
c. Media depicting deceased individuals: We may require you to remove or remove directly any media that depicts the death of an identifiable individual if we receive a request from their family or an authorized representative.
d. Graphic violence and adult content: We consider graphic violence to be any form of gory media related to death, serious injury, violence, or surgical procedures. We consider adult content to be any media that is pornographic and/or may be intended to cause sexual arousal.
Judget allows some forms of graphic violence and/or adult content in cases where the content is legitimately relevant to the issue of the posted case. These characteristics will be appreciated on the context of each case, upon the reporting of the content. However, you may not use such content in your profile, or header images. Additionally, Judget may sometimes require you to remove, or remove directly, content that depicts excessively graphic violence.
e. We prohibit glorification of violence. We consider glorification of violence to be behaviour that condones or celebrates violence (and/or its perpetrators) in a manner that may promote imitation of the act. This includes, but is not limited to, the glorification of mass murders, terrorist attacks, violent attacks, rapes or sexual assault. We also prohibit the glorification of violence where protected categories have been the primary target or victim.
C. Zero tolerance on child sexual exploitation:
You may not promote or encourage child sexual exploitation.
Regardless of the intent, viewing, sharing, or linking to child sexual exploitation media contributes to the re-victimization of the depicted minor and, therefore, is not allowed on Judget. This also applies to content that may further contribute to victimization of children through promotion or glorification of child sexual exploitation.
For the purposes of this policy, a minor means any person under the age of 18 years. Examples of content that depicts or promotes child sexual exploitation include, but are not limited to:
- Visual depiction of a minor engaging in sexually explicit or sexually suggestive act.
- Illustrated, computer-generated or other forms of realistic depictions of a human minor in a sexually explicit context or engaged in a sexually explicit act.
- Links to third-party sites that host child sexual exploitation material.
The following behaviours are also not allowed on Judget:
- Fantasizing about or promoting engagement in child sexual exploitation.
- Expressing a desire to obtain materials that feature child sexual exploitation.
- Recruiting, advertising or expressing interest in: (1) a commercial sex act involving a child, or (2) in harbouring and/or transporting a child for sexual purposes.
- Posting sexually explicit images to a child.
- Engaging a minor in a sexually explicit conversation.
- Trying to obtain sexually explicit images from a minor or trying to recruit a minor for sexual services through incentive or blackmail.
- Identifying alleged victims of childhood sexual exploitation by name or photo.
Consequences:
In a limited number of situations when undoubtedly non-malicious intent has been identified, users may be asked to remove the violating content and be temporarily locked out of their account before they can reactivate it.
However, in the majority of cases, the consequence for violating our child sexual exploitation policy is immediate and permanent suspension of your account. Violators will not be allowed to create new accounts in the future. In addition, upon our own initiative, or upon the reporting of a victim or a relative of the victim of such violation, we may contact the relevant legal authorities.
II. Respect the Law
As noted in Section 2.4 of our Terms of Services, you must comply with any applicable laws, regulations or court decisions throughout your use of the Judget platform. Your behaviour within the platform is your sole responsibility and you must acknowledge and respect the law that applies to you within the jurisdictions that may be concerned.
a. Unlawful use: You may not use Judget for any illegal purposes.
You may not use our service for any unlawful purposes or in furtherance of illegal activities. By using Judget, you agree to comply with all applicable laws and regulations governing your online conduct and content in your applicable jurisdiction.
b. Intellectual property. The content you create may not infringe someone’s Trademark and Copyright laws.
Here at Judget we expect our users to respect the intellectual propert rights of others. We ask our users to take care and avoid infringing the copyright and trademark of others.
Trademark: We prohibit any trademark violation within our platform. You may not use another person’s trademark rights as your own. We also prohibit the sale of promotion of counterfeit goods. We reserve the right to suspend accounts or take other appropriate action when someone’s brand or trademark, including business name and/or logo, is used in a manner that may mislead or confuse others about your brand affiliation.
Copyright: We will respond to clear and complete notices of alleged copyright infringement. If you believe that your trademark or copyright have been infringed, you may use our in-product reporting tool or contact us via Αυτή η διεύθυνση ηλεκτρονικού ταχυδρομείου προστατεύεται από τους αυτοματισμούς αποστολέων ανεπιθύμητων μηνυμάτων. We will investigate your request and we may require proof of ownership of trademark or copyright to take necessary action in order to stop the said infringement within our platform.
c. Distribution of hacked materials: you may not share any illegally obtained content.
We do not permit the use of our services to directly distribute content illegally obtained through hacking that contains personally identifiable information that may put people in imminent harm or danger or contains trade secrets. Direct distribution of hacked materials includes posting hacked content on Judget or directly linking to hacked content hosted on other websites. If the information or content you have posted is reported to be issued by a hacked source, we will investigate the source of the content and permanently remove the content if it is apparent that it is from a hacked source.
We may suspend accounts which directly distribute hacked materials where the account has made a claim of responsibility for a hack, or where Judget is able to reliably attribute a hack to the account distributing that content.
III.Respect the rights of others
A. Misuse of usernames
Username squatting: You may not engage in username squatting. Some of the factors we take into consideration when determining whether conduct is username squatting include:
- the number of accounts created;
- the creation of accounts for the purpose of preventing others from using those account names;
- the creation of accounts for the purpose of selling those accounts; and
- the use of third-party content feeds to update and maintain accounts under the names of those third parties.
If we become aware of any username squatting, we may require to you to stop and if you do not comply with our request, we may temporarily suspend your account.
Please note that Judget may also remove accounts that are inactive for more than six months.
B. Distribution of sensitive information.
You may not distribute content that contains personally identifiable information that may put people in imminent danger or harm or contains any legally confidential information. Such information includes first and last name, phone number, home or professional address or e-mail of an individual whose information is protected for safety reasons. If such information is available publicly outside the Judget platform, we may deem such information as non-sensitive. The appreciation of the sensitivity is on a case by case basis.
If your content has been reported as distributing sensitive information, we will appreciate the report and may require you to remove the said content. If you do not comply with our request, we will remove the content unilaterally and we may temporarily suspend your account.
C. Private information and intimate media
1. Private information:
Posting someone’s private information online may pose serious safety and security risks for the person whose information is shared. As such, this is considered one of the most serious violations of the Judget Platform.
You may not publish or post other people's private information without their express authorization and permission. Definitions of private information may vary depending on local laws.
Some examples of private information include (but may not be limited to) private contact or financial information, such as:
- credit card information
- social security or other national identity numbers
- private residences, personal home addresses, or other locations that are considered private
- non-public, personal phone numbers
- non-public, personal email addresses.
Some examples of information that is not considered private include:
- name
- birthdate or age
- business addresses
- places of education or employment
- descriptions of appearance
Please keep in mind that although you may consider certain information to be private, not all postings of such information may be a violation of this policy. We consider the nature and public availability of the information posted, local privacy laws, and other case-specific facts. For example, if information was previously posted or displayed elsewhere on the Internet prior to being put on Judget (e.g., someone lists their personal phone number on their public blog), it may not be a violation of this policy. However, if the publicly available information is being shared to harass or incite harassment, then we may take enforcement action under our abusive behaviour policy.
The consequences for violating our private information policy depend on the severity of the violation and the person’s previous record of violations.
The first time someone violates this policy they will be required to remove the violating post and/or temporarily locked out of their account before they can post again. People who violate this policy more than once and/or accounts dedicated to posting private information may be suspended.
2. Intimate media and content.
You may not post or share intimate photos or videos of someone that were produced or distributed without their consent. Content depicting sexual violence and/or assault is also not permitted. Note: limited exceptions may apply if there is clear context that the interaction is consensual. Even if the media is posted is relevant to the context of the case posted, we do not permit intimate media without the consent of the individual involved.
Sharing explicit sexual images or videos of someone online without their consent is a violation of their privacy and one of the most serious violations of the Judget’s Terms of Use. In addition to posing serious safety and security risks, it may also result in psychological, physical and financial hardship for the person whose content is shared.
We prohibit the posting or sharing of intimate photos or videos that were or appear to have been taken or distributed without the subject's consent. Examples of intimate media that violate this policy include, but may not be limited to:
- hidden camera content involving nudity, partial nudity, and/or sexual acts
- images or videos that appear to have been taken secretly and in a way that allows the user to see the other person’s genitals, buttocks, or breasts (content sometimes referred to “creepshots” or “upskirts”)
- images or videos that superimpose an individual’s face onto another person’s nude body;
- images or videos captured in a private setting and not intended for public distribution
- images or videos that are considered and treated as private under applicable laws and regulations.
Finally, media depicting sexual violence and/or assault (real or simulated) is prohibited even if such media is related to the posted case.
Note: Some forms of adult content and consensual nudity are permitted on Judget. For this reason, we need to evaluate context to recognize if content has been created and/or shared with or without the consent of those involved. We also permit some form of adult content when it is posted as a form of art.
We need to hear directly from the individual(s) featured (or their authorized representative) to ensure that we have sufficient context before taking any enforcement action.
3. Consequences:
We will immediately and permanently suspend any account that we identify as the original poster of intimate media that was created or distributed without the subject’s consent, as well as any account that solely posts this type of content.
In other cases, we may not suspend an account immediately. This is because some people who share this content may do so inadvertently, to express shock, disbelief or to denounce this practice. In these cases, we will require the user to remove the violating content and temporarily lock them out of their account before they can post again. Further violations of this policy will result in permanent account suspension.
D. Threats to expose / hack.
You may not threaten to expose someone’s private information or intimate media. You also may not threaten to hack or break into someone’s digital information or attempt to incentivize others to do so (e.g., through setting a bounty or reward on such actions). If you engage in such conduct we will take appropriate enforcement actions and may permanently suspend your account.
E. Impersonation:
You may not impersonate individuals, groups, or organizations in a manner that is intended to or does mislead, confuse, or deceive others. While you may maintain parody, fan, commentary, or newsfeed accounts, you may not do so if the intent of the account is to engage in spamming or abusive behaviour. If you engage in such conduct we will take appropriate enforcement actions and may permanently suspend your account.
IV. Respect the Judget Platform
A. Security
We strive to protect people on Judget from technical abuse and spam.
To promote a stable and secure environment on Judget, you may not do, or attempt to do, any of the following while accessing or using Judget:
- Access, tamper with, or use non-public areas of Judget, Judget’s computer systems, or the technical delivery systems of Judget’s providers.
- Probe, scan, or test the vulnerability of any system or network, or breach or circumvent any security or authentication measures.
- Access or search, or attempt to access or search, Judget by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by Judget Ltd (and only pursuant to the applicable terms and conditions), unless you have been specifically allowed to do so in a separate agreement with Judget.
- Forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use Judget to send altered, deceptive, or false source-identifying information.
- Interfere with or disrupt the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing Judget’s services, or by scripting the creation of content in such a manner as to interfere with or create an undue burden on Judget.
Any accounts engaging in the following activities may be temporarily locked or subject to permanent suspension:
D. Malware/Phishing:
You may not publish or link to malicious content intended to damage or disrupt another person’s browser or computer or to compromise a person’s privacy.
E. Fake accounts:
You may not register or create fake and misleading accounts. You may not use misleading account information in order to engage in spamming, abusive, or disruptive behaviour, including attempts to manipulate the conversations on Judget. Some of the factors that we take into account when determining whether an account is fake include:
o Use of stock or stolen avatar photos
o Use of stolen or copied profile bios
o Use of intentionally misleading profile information, including profile location
You may however use Judget pseudonymously or as a parody, commentary or fan account. If you are using an account as a parody, commentary or fan account, your bio and account name should clearly indicate that you are not affiliated with the subject of the account.
F. Spam:
You may not use Judget’s services for the purpose of spamming anyone. Spam is generally defined on Judget as bulk or aggressive activity that attempts to manipulate or disrupt Judget or the experience of users on Judget to drive traffic or attention to unrelated accounts, products, services, or initiatives. Some of the factors that we take into account when determining what conduct is considered to be spamming include:
a. if a large number of people have blocked you in response to high volumes of untargeted, unsolicited, or duplicative content or engagements from your account
b. İf you have shared a large number of cases on the feed in a short period of time with only a link and no arguments or title for the purposes of driving traffic and attention to a given product or services.
c. if a large number of spam complaints have been filed against you;
d. if you post duplicative or substantially similar content, replies, or mentions over multiple accounts or multiple duplicate updates on one account, or create duplicate or substantially similar accounts;
e. if you post multiple updates to a trending or popular hashtag with an intent to subvert or manipulate the hashtag to drive traffic or attention to unrelated accounts, products, services, or initiatives;
f. if the verdicts you post are solely destined to drive traffic or attention to an unrelated product or services.
g. if you add users to lists in a bulk or aggressive manner;
h. if you are randomly or aggressively engaging by posting cases to drive traffic or attention to unrelated accounts, products, services, or initiatives;
i. if you repeatedly post other people’s account information as your own
j. if you post misleading, deceptive, or malicious links
k. if you sell, purchase, or attempt to artificially inflate account interactions
l. if you use or promote third-party services or apps that claim to get you more upvotes or verdicts in exchange of a fee or favour.
Consequences: If you engage in such spamming conduct, we will issue a warning and may temporarily suspend your account. Subsequent violations may result in the permanent deletion of your account.
Accounts created to replace, or mimic suspended accounts may be permanently suspended. We may also remove accounts which Judget is able to reliably attribute to entities known to violate the Judget Rules.
V. Reporting and measures of enforcement.
We are doing the best of our ability to prevent any violation of these Terms of Use and try to ensure that each and every one of our users respects them. We do not however currently have the means to technically monitor all content posted on Judget at all times. We therefore also rely on our users and encourage them to actively report any content that they notice and deem to constitute a violation of these Terms of Use.
Whether you are a direct victim of a violation, or simply notice any content that violates these Terms of Use or any other Terms and Policies of the Judget platform, please report it to us as soon as possible via either our in product reporting tool or by contacting us at Αυτή η διεύθυνση ηλεκτρονικού ταχυδρομείου προστατεύεται από τους αυτοματισμούς αποστολέων ανεπιθύμητων μηνυμάτων. If, after a thorough investigation, we believe that a behaviour or a content that has been posted within the Judget platform constitutes a violation of these Terms of Use the consequences of such violation will depend on the circumstances and the context of the incident at hand. The determination of the penalty and its enforcement will depend on a variety of factors such as the severity of the violation or the author’s previous record of violations, as well as the legitimacy of the alleged offense for the public knowledge and record.
The enforcement actions may be one of the following:
- A warning issued to the user responsible of the offensive content as well as a request to delete the content.
- A warning issued to the user responsible for the offensive content and a direct deletion of the content by us.
- A temporary suspension of the account of the responsible user and a permanent deletion of the content from the platform.
- A permanent suspension of the account of the responsible user and a permanent deletion of the offensive content.
Limitations on trending content.
At times, we may prevent certain content from trending. This includes content that violates the Judget Terms of Use and other Judget Terms and Policies We may also prevent content that may attempt to manipulate trends
VI. Concluding remarks
Judget is a platform that encourages its users to share and judge disputes and injustices. Contentious and divisive situations are therefore likely to be at the core of Judget ‘s traffic. And we acknowledge that dealing with such situations may not be easy for our passionate users.
We are committed to ensure a civil and safe environment for our users and expect them to have a mature and responsible behaviour within our platform. This is why the importance of these Terms of Use cannot be stressed enough.
We also would like to note that this Terms of Use constitute a binding legal agreement between you and Us and governs your behaviour within the Judget Platform. We hope you have thoroughly read and acknowledged these terms before you agree to it.
